Welcome to Osmos Global. These Terms and Conditions ("Terms") govern your access to and use of the Osmos Global website, including all content, features, and services offered (the "Platform"). By using the Platform, you agree to be bound by these Terms. Please read them carefully.

1. Acceptance of Terms

By creating an account, accessing content, or otherwise using the Platform, you agree to comply with and be legally bound by these Terms. If you do not agree, you must not use the Platform. We reserve the right to update these Terms at any time; your continued use constitutes acceptance of the changes.

2. User Accounts and Responsibilities

To access certain features (e.g., job posting, course enrollment, event registration), you may need to create an account.

  • Account security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
  • Accuracy of information: You agree to provide accurate, current, and complete information during registration and to update it as necessary.

3. User Conduct and Acceptable Use

This is a professional community. You agree to use the Platform responsibly and for lawful purposes only.

You must not:

  • Post unlawful or harmful content: This includes, but is not limited to, content that is defamatory, obscene, threatening, harassing, discriminatory, or infringes on the intellectual property rights of others.
  • Post misleading information: You are responsible for the accuracy of any job postings, event descriptions, or comments you submit. Do not post fraudulent or deceptive content.
  • Disrupt the Platform: Do not transmit any viruses, malware, or other code of a destructive nature, or engage in any activity that could damage, disable, or impair the Platform or interfere with other users' use of it.
  • Engage in unauthorized access: Do not attempt to gain unauthorized access to any part of the Platform, other user accounts, or our networks.
  • Misrepresent yourself: Do not impersonate any other person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.

You are solely responsible for all content you submit and any consequences that arise from it.

4. Intellectual Property Rights

Our property: The Platform and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Osmos Global and are protected by copyright, trademark, and other intellectual property laws.

  • You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for your personal, non-commercial use.
  • You may not reproduce, distribute, modify, create derivative works of, publicly display, or republish any of our proprietary content without our prior written consent.

User content: By posting content (e.g., articles, job listings, comments) on the Platform, you grant Osmos Global a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content for the purpose of operating and promoting the Platform. You represent that you own or have the necessary rights to any content you post.

5. Limitation of Liability and Disclaimer of Warranties

  • "As is" and "as available": THE PLATFORM AND ALL INFORMATION, CONTENT, AND SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE PLATFORM ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND. OSMOS GLOBAL EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  • No liability for damages: TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL OSMOS GLOBAL, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR ACCESS TO OR USE OF THE PLATFORM. This includes, but is not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, even if we have been advised of the possibility of such damages.
  • User interactions: Osmos Global is a platform for connection and information. We are not a party to any agreements between users (e.g., employers and job applicants). We are not liable for the conduct, whether online or offline, of any user, or for any content posted by third parties.
  • Maximum liability: If any liability is found, our total aggregate liability to you for all claims arising from or related to the Platform shall not exceed the amount you paid us, if any, or one hundred U.S. dollars ($100.00), whichever is greater. Please note that some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages, so the above limitations may not apply to you.

6. Dispute Resolution and Governing Law

  • Governing law: This Agreement and any dispute arising out of or in connection with it shall be governed by and construed in accordance with the laws of Bangalore, Karnataka, India, without regard to its conflict of law provisions.
  • Dispute resolution: The parties agree to use their best efforts to settle any dispute, claim, question, or disagreement directly through consultation and good faith negotiations. If the dispute cannot be resolved through negotiation, it shall be finally resolved by binding arbitration administered by a recognized arbitration body in accordance with its commercial arbitration rules.
  • Place of arbitration: The place of arbitration shall be Bangalore, Karnataka, India.
  • Number of arbitrators: The dispute shall be resolved by a single, neutral arbitrator.
  • Language: The language of the arbitration shall be English.
  • Class action waiver: All claims must be brought in the parties' individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. You agree that you may bring claims against Osmos Global only in your individual capacity and not as a class action.
